One of the most common questions we receive at Space Cabins NZ is whether you need building consent before installing a portable cabin, tiny home, or modular structure on your property. The answer depends on several factors. This guide explains what you need to know.
What Is Building Consent in New Zealand?
Building consent is approval from your local council to carry out building work. In New Zealand, the Building Act 2004 governs what types of work require consent and what is exempt.
When Is a Portable Cabin Exempt from Building Consent?
Under Schedule 1 of the New Zealand Building Act, certain building work is exempt from requiring a building consent. Portable structures may be exempt if they meet specific criteria, including:
- The structure is no more than 30m2 in floor area
- It is a single-storey structure
- It is not used as a place where people sleep regularly (for some categories)
- It meets the relevant building standards for its type
Note that even exempt buildings must still meet the requirements of the Building Code.
When Do You Need Building Consent for a Cabin?
You will generally need building consent if your structure:
- Is larger than 30m2
- Is a two-storey structure
- Will be used as a permanent residence
- Requires connection to services (water, drainage, electricity in some cases)
- Is located in a special area (flood zone, heritage area, etc.)
What About Resource Consent?
In addition to building consent, you may also need resource consent depending on your zoning and district plan rules. This is separate from building consent and is issued by your local council under the Resource Management Act. Factors include setbacks from boundaries, maximum site coverage, and permitted uses for your zone.
Does It Matter Where the Cabin Is Placed?
Yes. Placement on your property matters. Most district plans have rules about how close a structure can be to boundaries, roads, and other buildings. Rural zones tend to have more flexibility than urban residential zones.
